Pursuant to GC § 36933(c)(1), the City must publish a summary of a proposed ordinance or a proposed amendment to an ordinance provided that the summary is posted in the manner specified in GC § 36933(a) at least five (5) days prior to adoption of the proposal and within fifteen (15) days after adoption with the names of the Council Members voting for and against the proposal.

ORDINANCE NO. 25-1011

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MONTCLAIR ACTING IN ITS CAPACITY AS THE LEGISLATIVE BODY OF THE CITY OF MONTCLAIR COMMUNITY FACILITIES DISTRICT NO. 2025-1 (THE VILLAGE AT MONTCLAIR) AUTHORIZING THE LEVY OF A SPECIAL TAX IN SUCH COMMUNITY FACILITIES DISTRICT.

Summary

The City Council of the City has conducted proceedings to establish CFD No. 2025-1. By passing the Ordinance, the City Council authorizes and levies the special tax within CFD No. 2025-1.The special tax revenue will be used to pay for the costs of services, including without limitation the costs of providing:

  • (a) maintenance services including,
    • (i) the maintenance and lighting of parks, parkways, streets, roads and open space, and
    • (ii) flood and storm protection services, including but not limited to, the operation and maintenance of bio-retention basins and storm drainage systems;
  • (b) public safety services, including
    • (i) fire protection and suppression services and
    • (ii) police protection services; and
  • (c) other services, including
    • (i) maintenance and operation of any real property or other tangible property with an estimated useful life of five or more years that is owned by the City, and
    • (ii) any other services authorized to be financed pursuant to the Mello-Roos Community Facilities Act of 1982.

CFD No. 2025-1 will also finance costs associated with the determination of the amount and the levy and collection of special taxes to provide such services and costs otherwise incurred to carry out the authorized purposes of CFD No. 2025-1.

History

The Ordinance was introduced for first reading at a regular City Council meeting held on Monday, March 3, 2025, which was approved by a 5-0 vote (Dutrey, Martinez, Ruh, Lopez, Mendez voting in favor).

A Public Hearing is scheduled to take place before the City Council at its regular meeting on Monday, March 17, 2025, at 7:00 p.m. in the Council Chambers located at City Hall, 5111 Benito Street, Montclair, California to hear comments from the public prior to consideration of the Ordinance’s adoption.

Effective Date

30 days after adoption.
